51. Foreseeable Loss

Where applicable consumer law applies, we remain responsible for losses caused by our breach where such liability cannot legally be excluded.

We do not seek to exclude liability for loss that applicable mandatory law considers reasonably foreseeable as a result of our failure to perform the contract.

We are generally not responsible for purely business or commercial losses suffered by a consumer purchasing a product for private purposes where such losses are not legally recoverable from us.


52. Non-Excludable Liability

Nothing in these Terms excludes or limits liability that applicable law prohibits us from excluding or limiting.

Depending on applicable law, this may include certain liability arising from:

  • fraud;
  • intentional misconduct;
  • death or personal injury;
  • gross negligence;
  • mandatory consumer guarantees;
  • defective digital content;
  • or other legally protected rights.

If a limitation in these Terms conflicts with mandatory law, the mandatory law takes priority.


53. Force Majeure and Events Outside Our Control

We are not responsible for delays caused by circumstances genuinely outside our reasonable control to the extent permitted by law.

Examples may include:

  • natural disasters;
  • large-scale internet outages;
  • infrastructure failures;
  • war;
  • government restrictions;
  • widespread cyber incidents;
  • or comparable events.

We will take reasonable steps to minimize disruption.

This provision does not remove a right to a refund or termination where applicable law grants that right because we ultimately fail to supply what you purchased.


54. Privacy

Our handling of personal information is governed by our Privacy Policy.

The Privacy Policy explains matters including:

  • information we collect;
  • Shopify processing;
  • cookies;
  • advertising;
  • customer support;
  • AI-assisted processing;
  • retention;
  • international data transfers;
  • and privacy rights.

These Terms do not replace the Privacy Policy.


55. Electronic Communications

By purchasing online, you understand that transaction-related communications may be provided electronically.

These may include:

  • order confirmations;
  • payment information;
  • download links;
  • delivery instructions;
  • account information;
  • support messages;
  • refund communications; and
  • legally required notices.

Transactional communications are separate from optional promotional marketing.


56. Changes to Products

We may make reasonable changes to products to:

  • correct mistakes;
  • maintain security;
  • maintain compatibility;
  • improve formatting;
  • clarify content;
  • update factual information; or
  • comply with legal requirements.

We will not rely on this section to materially remove a benefit that formed part of your purchase where doing so would violate applicable law.


57. Changes to These Terms

We may update these Terms from time to time because of changes in:

  • law;
  • our products;
  • technology;
  • service providers;
  • business operations;
  • or security requirements.

The updated version will display a revised Last Updated date.

Changes will not retroactively remove contractual or statutory rights that already arose from an earlier purchase where applicable law prevents us from doing so.

Where further notice or consent is required, we will provide it.


58. Transfer of Our Business

We may transfer rights or obligations in connection with:

  • a merger;
  • business sale;
  • restructuring;
  • transfer of the Steadier Days brand;
  • acquisition; or
  • similar legitimate transaction.

Where you are a consumer, such a transfer will not reduce mandatory rights that you already have.


59. Transfer of Your Rights

The personal license granted to use our digital products is generally non-transferable.

You may not resell, sublicense, or transfer the licensed digital content to another person except where:

  • we expressly agree;
  • applicable law expressly permits it; or
  • contractual restrictions cannot lawfully apply.

60. No Waiver

If we do not immediately enforce a provision of these Terms, that does not mean we permanently waive our right to enforce it later.

Similarly, your statutory rights are not automatically lost merely because they are not immediately exercised, subject to applicable lawful limitation periods.


61. Severability

If a court or competent authority determines that part of these Terms is invalid, unlawful, or unenforceable, that provision will be disregarded or interpreted only to the extent necessary.

The remainder of the Terms will continue to apply where legally possible.

An invalid provision will not be replaced with a term that gives Steadier Days greater rights than applicable law permits.


62. Interpretation

These Terms are intended to use reasonably clear language.

Where mandatory consumer law requires an ambiguous standard term to be interpreted in favor of the consumer, that rule applies.

Headings are included for convenience and do not change the substantive meaning of the provisions.


63. Applicable Law

These Terms and contracts with Steadier Days are governed by the laws of the Netherlands, subject to mandatory consumer-protection and conflict-of-law rules.

If you are a consumer residing in another country, this choice of Dutch law does not deprive you of mandatory protections granted by applicable law that cannot contractually be waived.

We will make a reasonable effort to resolve legitimate concerns directly.

Nothing in these Terms requires a consumer to give up access to a court, authority, complaint procedure, or dispute mechanism where applicable law provides such a right.


65. Consumer Jurisdiction

Where mandatory law determines which courts may hear a consumer dispute, those rules apply.

These Terms are not intended to force a consumer to litigate exclusively in the Netherlands where mandatory law permits that consumer to bring proceedings elsewhere.


66. Business Customers

If a product is purchased entirely for business or professional purposes, mandatory consumer protections may not apply.

Unless a separate commercial licensing agreement is entered into, purchase of an ordinary Steadier Days product does not grant commercial reproduction or distribution rights.

For non-consumer transactions, additional contractual limitations may apply to the extent permitted by law.


67. Entire Agreement

The agreement relating to a purchase may consist of:

  • these Terms;
  • the relevant product page;
  • the selected package;
  • the price;
  • checkout information;
  • order confirmation;
  • our Refund Policy;
  • and specific conditions expressly presented for the purchase.

Nothing in this provision allows us to disregard representations or consumer information that applicable law makes binding.


68. Language

These Terms are currently provided in English.

Translations may be made available for convenience.

We will not rely on a translation discrepancy to reduce a consumer right granted by mandatory law.
